Smec Future Oil Terms & Conditions
Introduction
The website www.smecfutureoil.co.za (the “Website”/”Site”) is owned and operated by Smec Future Oil (Pty) Ltd, registered at Unit 12, Main Reef Park, Dunswart, Boksburg, 1508. By placing an order through this Website, you are entering into a sales contract with Smec Future Oil (Pty) Ltd and agreeing to be bound by these Terms and Conditions and the Purchase Terms mentioned below.
Definitions
In this document, the following terms shall have the following meanings:
“Buyer” refers to the person who purchases Goods from the Seller.
“Goods” refers to the products that the Buyer agrees to purchase from the Seller.
“List Price” refers to the list of prices of the Goods maintained by the Seller, which may be amended from time to time.
“Seller” refers to Industrial Trading Smec Future Oil Lubricants.
“Terms and Conditions” refers to the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
“Smec Future Oil” refers to Smec Future Oil (Pty) Ltd, the sole owner of Smec Future Oil products, trademarks, and all intellectual properties associated with the Smec Future Oil brand.
When do these Purchase Terms apply?
These Purchase Terms apply to all offers and contracts related to the sale and delivery of Products by Smec Future Oil (Pty) Ltd. By ordering anything from the Website or any web page directly connected to the Website or by accepting an offer from Smec Future Oil, you agree to be bound by these Purchase Terms. Any deviation from these Purchase Terms is only possible if agreed in writing by Smec Future Oil.
Conditions to conclude a contract with Smec Future Oil
You must be 18 years of age or older to purchase Products via the Website. Both consumers and resellers can order on the Website. You guarantee that the information you provide to Smec Future Oil in the request or order is accurate and complete. Please note that for limited edition or limited production Products, extra restrictions such as a limit to the number of such Products per order may apply.
When does a contract become binding between you and Smec Future Oil?
Please note that all information on the Website is considered an invitation to treat and is not considered to be an offer or binding contract. By placing an order, you are making an offer to purchase the Products listed in your order. Smec Future Oil reserves the right to verify any order in advance and refuse to accept any order without providing reasons and with no liability to you or any third parties. If we do not confirm acceptance of your order within ten working days, it is deemed to have been refused. All orders submitted by you are subject to acceptance by Smec Future Oil, and we may choose not to accept your order at our own discretion. Some examples of when we may refuse your order are:
If we are unable to obtain authorisation for your payment;
If the Products are not available;
If shipping restrictions may apply to the Products;
If the Products shown on the Website contain a manifest error such as being incorrectly priced or otherwise incorrectly described.
Once you have placed an order, we will send you an order acknowledgment email with your order number, details of the Products you have offered to purchase, and details of any delivery services.
Ownership Transfer
Please note that all Products will remain the property of Smec Future Oil until you have paid all amounts owing to us in full under any agreement, including the payment of costs, earlier or later deliveries, or partial deliveries. You are not permitted to sell, dispose of, or encumber any product before the full title has passed to you and or without written permission from Smec Future Oil.
Quality and Appearance of Products
Smec Future Oil (Pty) Ltd (hereafter referred to as “Smec Future Oil”) strives to provide the most accurate product descriptions and images possible on the website. However, minor variations in color or other product specifications may occur due to factors such as image acquisition, display technologies or other technical reasons beyond our control. Therefore, Smec Future Oil is not liable for any such deviations.
Please note that Smec Future Oil is not liable for any damage resulting from the incorrect use of Products, including use that is contrary to the instructions provided. Nevertheless, Smec Future Oil warrants that at the time of delivery, the Goods will correspond to the description given by the Seller.
Order Cancellation
If you wish to cancel your order, you may do so before the goods are dispatched by contacting the Smec Future Oil team at www.smecfutureoil.co.za/contact-us.
Price of the Products
All prices displayed on the Website are quoted in South African Rand and include VAT at the end of our cart total. Smec Future Oil reserves the right to change, limit, or terminate any special offers or discounts at any time. Delivery costs, if applicable, will be charged separately and itemized in the total amount of the order.
Payment Methods
Smec Future Oil accepts payments made by debit cards (Maestro and Visa), credit cards (Mastercard and Visa), EFT/bank transfers, and invoicing. Smec Future Oil reserves the right to issue electronic invoices, and you agree to receive such forms of invoicing. The invoice will correspond to the details provided to our company during the online purchase phase.
Delivery
Smec Future Oil will deliver during business hours to the address indicated by you within South Africa. Smec Future Oil can only deliver to a home or office address. All orders will be processed within 1-2 business days, and delivery times typically range from 2-7 business days for South African deliveries. Please note that Smec Future Oil is not in full control of transport time frames of third parties such as outsourced couriers or freight & logistics companies. However, we will endeavor to inform you of ETA’s communicated to us as accurately and timeously as possible and will assist in resolving any issues related to the delivery of the service.
Logistics and Delivery
Smec Future Oil use reputable carriers to deliver all orders within South Africa. The carrier used will be confirmed upon dispatch of the order. Once the order has been dispatched, we will provide you with tracking information so that you can monitor the progress of your order.
In the event that an item is not immediately available, we will ship the part of your order that is in stock and the remaining items will be shipped as soon as they become available. You will not be charged any additional shipping and handling fees for the second shipment. If you prefer, you may request a full refund for the items that are not available.
Returns, Refunds, and Exchanges
Upon receipt of your order, please inspect the Goods immediately and notify Smec Future Oil within 24 hours if the Goods are damaged or do not comply with any of the contracts. Claims for damaged items must be signed for as damaged on delivery or reported within 24 hours of delivery.
If there is a claim of defect or damage, Smec Future Oil will be responsible for collecting the faulty Goods or the Buyer may return the Goods to the Seller. If the Goods are found to be defective, the Buyer shall be entitled to replacement Goods or a full refund (including delivery costs, if applicable) plus any return postal charges. Goods returned must clearly show the order number obtained from the Seller on the package.
If the Goods are found to be damaged due to the Buyer’s fault, the Buyer will be liable for the cost of remedying such damage and courier costs associated with the purchase.
To return an item, please email pictures of the unopened product to conrad@smecfutureoil.co.za to request a refund/return. We will then provide you with a tracking number for the return. The item or product that you purchased from us must be in its original container and still be sealed or unopened, and the packaging or container you received it in must be in an undamaged condition unless there is a manufacturer defect. The product that has been opened or partially used will not be accepted for return or exchange. You must return the item within 30 days of your purchase.
Include with your returned product a signed letter stating the reason for your return and the original receipt. All returned items are subject to a 10% administration fee, which will be deducted from your refund should your return be accepted and authorized. We do not refund the original shipping and handling fees that you paid on the order.
Exchanges are allowed if you have ordered the incorrect product and it has been delivered as per the order. Please mail pictures of the product to conrad@smecfutureoil.co.za. You will still be subject to a return fee of 10% and will again be billed for the second shipping cost of the product to you.
Force Majeure
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery, or shortage or unavailability of raw materials from a natural source of supply. In such cases, the party affected shall be entitled to a reasonable extension of its obligation.
